These Terms and Conditions govern your use of this website and your engagement with the services provided by Phak Pheun Counsel. Please read them carefully. By using this website or engaging our services, you agree to these terms.

1. Definitions

In these Terms and Conditions:

  • "Agreement" means these Terms and Conditions together with any service engagement letter or written confirmation.
  • "We / Us / Our" refers to Phak Pheun Counsel, a family law practice registered in Bangkok, Thailand.
  • "Services" refers to the family law advisory services we offer: Domestic Relations Consultation, Protective Order Preparation, and Long-term Family Plan Drafting.
  • "User / You" refers to any person who visits this website or engages our Services.
  • "Content" refers to all text, documents, and written materials on this website and produced in connection with our Services.

2. Acceptance of terms

By accessing this website or enquiring about or engaging our Services, you confirm that you are at least 18 years of age, that you have the legal capacity to enter into this Agreement, and that you accept these terms.

If you are acting on behalf of another person, you confirm that you have authority to bind that person to these terms.

3. Services provided

Phak Pheun Counsel provides private family law advisory services in Bangkok, Thailand. Our three current service offerings are:

  • Domestic Relations Consultation (4,300 THB) — a private consultation session resulting in a written note of options.
  • Protective Order Preparation (8,500 THB) — preparation and submission of a protective order application under Thai law.
  • Long-term Family Plan Drafting (13,200 THB) — a comprehensive plan document covering household, financial, and child-related arrangements, with an annual review schedule.

Services are available to clients located in Thailand. We are not a dispute resolution or court representation service unless specifically agreed in writing in a separate engagement. Our Services are advisory in nature and do not constitute representation in legal proceedings except where expressly agreed.

4. Your responsibilities

When using this website or engaging our Services, you agree to:

  • Provide accurate and truthful information in any enquiry or consultation.
  • Not use this website for any unlawful purpose or in a manner that could damage, disable, or impair the website.
  • Not attempt to gain unauthorised access to any part of this website or its systems.
  • Treat our advisers with professional courtesy in all communications.

You acknowledge that the quality of legal advice we can provide depends on the accuracy and completeness of the information you share with us.

5. Intellectual property

All content on this website — including text, layout, and design — is the property of Phak Pheun Counsel and is protected under applicable Thai intellectual property law. You may not reproduce, distribute, or otherwise use any content from this website without our prior written permission.

Written documents produced as part of our Services (consultation notes, plan documents, and similar outputs) are provided for your personal use in connection with your family matter. They may not be reproduced for commercial purposes or provided to third parties for purposes unrelated to your matter without our consent.

6. Fees and payment

Our service fees are stated in Thai Baht (THB) and are fixed for each service as described in Section 3. The applicable fee is confirmed at the time of booking. Payment is required in advance of service delivery unless agreed otherwise in writing.

We accept payment by bank transfer and standard card payment. Payment details are provided at the time of booking confirmation.

Refunds: If you cancel an appointment more than 48 hours in advance, the fee paid will be refunded in full. Cancellations within 48 hours of a scheduled appointment are non-refundable unless rescheduled to a mutually agreed alternative time. Once a written output (consultation note, plan document) has been delivered, the fee for that service is non-refundable.

7. Service delivery terms

The following terms apply to the delivery of our Services:

  • We will respond to all initial enquiries within one working day.
  • Appointments are arranged at mutually agreed times. We offer appointments during standard office hours (Monday to Friday, 9:00–18:00) and, on request, at other times subject to availability.
  • Written outputs are provided to the client at or promptly following the relevant meeting or stage of work.
  • No step in a matter is taken without the client's prior agreement in writing or confirmed verbal agreement recorded in the file.
  • For Protective Order Preparation, the timeline of the matter is subject to the schedule of the relevant Thai authority. We do not control and cannot predict the processing time of external authorities.
  • For Long-term Family Plan Drafting, the annual review schedule is agreed at the conclusion of the plan drafting. Review appointments are subject to mutual availability.

8. Disclaimers

The information on this website is provided for general information only and does not constitute legal advice. No reliance should be placed on website content as a substitute for obtaining specific legal advice relevant to your circumstances.

We do not make any representation about the outcome of any legal matter. Advice provided during consultations reflects the law as it stands at the time of the consultation and the information you have provided. We cannot be responsible for outcomes resulting from information withheld or changes in law or circumstance following the delivery of advice.

The long-term family plan document is a practical framework and not a guaranteed legal instrument. Its legal effect depends on the specific provisions included and the circumstances in which it is relied upon. We will explain the legal character of each element of the plan at the time of drafting.

9. Limitation of liability

To the extent permitted by Thai law, our total liability in connection with any Service is limited to the fee paid for that Service. We are not liable for any indirect, consequential, or special damages arising from the use of our Services or this website.

Nothing in these terms limits our liability for fraud, wilful misconduct, or any other liability that cannot be limited under applicable law.

10. Indemnification

You agree to indemnify and hold Phak Pheun Counsel harmless from any claim, loss, or expense (including reasonable legal fees) arising from your breach of these Terms and Conditions, your misuse of this website, or any false or misleading information you provide in connection with our Services.

11. Termination

Either party may terminate an engagement at any time by giving written notice. On termination, any fees for work completed and delivered to that point remain payable. We will provide a written summary of the stage of any matter at the time of termination.

We reserve the right to decline or discontinue a service engagement where a conflict of interest arises, where the client has provided materially misleading information, or where we are required to do so by professional obligation. In such cases we will provide reasonable notice.

12. Governing law and disputes

These Terms and Conditions are governed by the laws of Thailand. Any dispute arising from these terms or our Services shall be subject to the jurisdiction of the courts of Bangkok, Thailand.

Before initiating any formal process, we encourage parties to attempt informal resolution by contacting us at [email protected]. We will endeavour to respond constructively within five working days.

13. General provisions

Entire agreement: These terms, together with any engagement letter or written confirmation, constitute the entire agreement between you and Phak Pheun Counsel in respect of your use of our Services.

Severability: If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force.

Waiver: Failure by us to enforce any provision does not constitute a waiver of that provision.

Assignment: You may not assign your rights under these terms without our written consent. We may assign our obligations to a qualified successor practice upon notice to you.

14. Changes to these terms

We may update these Terms and Conditions from time to time. The current version will always be available at this address. Continued use of this website or our Services following an update constitutes acceptance of the revised terms. Where changes are material, we will notify active clients by email with reasonable notice before the changes take effect.
